ASCRL has endorsed H.R.79133, the Generative AI Copyright Disclosure Act of 2024, introduced by Rep. Adam Schiff (D-CA) into the House of Representatives on April 9. If passed, H.R.79133 would require generative AI platforms to submit a notice to the Register of Copyrights prior to the release of a new generative AI system, providing a summary of the copyrighted works which were used in either building or altering the training dataset. This requirement would apply retroactively to any previously released generative AI systems and to any significant changes made to existing generative AI models. Non-complianet AI platforms could incur civil penalties starting at $5,000. The Copyright Office would be required to maintain a publicly available database of all notices.
In our letter of support for the bill, we stated, “The American Society for Collective Rights Licensing, the largest not-for-profit photography and illustrator association in the United States, enthusiastically supports the Generative AI Copyright Disclosure Act. This bill, which helps visual material authors identify possible uses of their works and any applicable URL sources, along with other legislation, can play an important role in fairly and properly remunerating authors for the exploitation of their works for the purposes of generative AI machine learning.”
